PAYLATER HUB TERMS OF USE FOR CUSTOMER

Please, read these mandatory terms of service before using our website/services.

These terms of use govern the use of our services via our website and mobile application and act as a legally binding agreement between Paylater Hub Ltd hereinafter referred to as “we/ our/ us/ company) and users (hereinafter referred to as customer/ you/ your). All rights and obligations of the users regarding the use of our services are incorporated in these terms of service.

1.  ABOUT PAYLATER HUB
   PAYLATER HUB is a Buy-Now-Pay-Later (BNPL) company that provides financing to users to facilitate immediate payment for purchases to merchants and immediate possession of goods/services while they pay back in convenient installment payment plans, whether online or offline.
   
   
2. ACKNOWLEDGMENT
   You hereby agree to be bound by these terms of services including all information, tools, additional terms and conditions, and policies referenced herein and/or available on our website/mobile application. If you do not agree with these terms of service or any part thereof, we strongly recommend that you do not access our services.
   
   
3. CONTRACTUAL CAPACITY AND ELIGIBILITY
   By accessing our services, you acknowledge that:
   • You are living in the Nigeria and have a permanent residential address;
   • You are 18 years of age or older;
   • You have an active email account registered in your name;
   • You have an active mobile phone number registered in your name;
   • You will provide only true, accurate, current, and complete information about yourself and you will maintain the accuracy of such information and promptly update such information as necessary;
   • You have given Us permission to access your banking information, obtain a credit report, retrieve bank account data, or collect other third-party data about you; and
   • You declare that any payment obligations arising from your purchase will be met by you pursuant to the payment terms agreed upon at the time of purchase or thereafter.

     In the following cases, you will not be eligible to use our services.

   • where you are below the legal age of majority, or
   • where you provided personal information which appears not to be accurate and exact, or
   • where you are found to be involved in any fraudulent activity, or by any means misusing our services for ulterior motives.
     
     
4. RIGHT TO AMEND THE TERMS OF USE
   PAYLATER HUB reserves the right to change or modify our services at any time without notice except for mentioning last updated date. If you continue using this after an update, it will mean that your consent was given up-to and including these new terms of use which go into effect immediately following their publication on the site’s homepage. It is your responsibility to periodically check the terms of use page for updates.
   
   
5. FEE AND CHARGES FOR AVAILING OUR SERVICES
   Our services are subject to a fee and interest charges. You hereby agree to pay fee and charges, along with the principal amount for the product you purchased. While opting for our financing option at the checkout, you are bound to choose any of the instalment plans that better suit your finances. PAYLATER HUB reserves the right to change the fees and charges at any time.
   
   
6. YOUR OBLIGATION TO PAY ON TIME
   By these terms of use, you are obligated to repay the amount as per the financing option you selected. In case you failed to repay the required amount on the scheduled date, late payment fees shall be levied against you until you make good the default.
   
   
7. THE EVENT OF DEFAULT
   You become subject to default when you fail to pay the due instalment amount on scheduled date. We may declare you as defaulter for the purpose of this terms of use for any of the following reasons:
   • Where you fail to pay any Instalment by the due date;
   • Where you violate any commitment, you make to us which significantly incapacitates your ability to pay the due amount or our ability to collect the amounts due under these terms of use;
   • Where you withdraw your consent to electronic communications; and
   • Where your provided information appears to be false and misleading. If you are in default, we can require you to pay the remaining amount you owe us at once. We will send notifications to you requesting you to pay the outstanding amount through any available means of communication.
     
     In addition, we may also opt for any of the following recovery mechanisms:
   • We may file a complaint with Credit Bureau;
   • We may initiate legal proceedings against you for collection of the outstanding amount you owe us, without prior legal notice;
   • We may proceed under any other available options if it appeared that your act was based on a desire to defraud us and
   • While proceeding under the aforementioned options, any cost, legal or otherwise, shall be collected from you in addition to recovery of the principal outstanding amount, interest charges, and late fees.
     
     
8. PRIVACY POLICY
   “User Personal Information” is any information about one of our Users which could, alone or together with other information, personally identify them or otherwise be reasonably linked or connected with them. Information such as a username and password, an email address, a real name, an Internet protocol (IP) address, and a photograph are examples of “User Personal Information.” User Personal Information does not include aggregated, non-personally-identifying information that does not identify a User or cannot otherwise be reasonably linked or connected with them. We may use such aggregated, non-personally identifying information for research purposes and to operate, analyze, improve, and optimize our Website and Service. Our use of your personal information is governed by our Privacy policy. You may use PAYLATER HUB Confidential Information only as necessary in exercising your rights granted in this Agreement. You agree not to disclose PAYLATER HUB Confidential Information without obtaining the prior written consent from PAYLATER HUB. You agree that you will protect PAYLATER HUB Confidential Information from unauthorized use, access, or disclosure in the same manner that you would protect your own confidential and proprietary information of a similar nature and in any event with no less than a reasonable degree of care.
    
    
19. ENTIRE AGREEMENT

    PAYLATER HUB shall have the right immediately to terminate this agreement with you and your use of the Website if it determines in its sole discretion that you have breached any of these Legal Terms of Services or otherwise been engaged in conduct which PAYLATER HUB determines in its sole discretion to be unacceptable. Any termination of this agreement shall not affect the respective rights and obligations (including without limitation, payment obligations) of the parties arising before the date of termination. You furthermore agree that the Site shall not be liable to you or to any other person as a result of any such suspension or termination.
